Terms and Conditions - FundUp Tournaments

  1. Object
    This document regulates the terms and conditions applicable to participation in Trading Tournaments organized by FundUp OÜ (hereinafter referred to as "FundUp"). These tournaments constitute a business unit independent from the funding accounts and may be free or paid according to the specific call.
  2. Eligibility
    .

Participation is limited to residents of countries where this type of competition is legal.

FundUp reserves the right to exclude restricted jurisdictions.

FundUp employees, their immediate family members or external collaborators related to the organization are not eligible to participate.

Not resident or located (directly or indirectly) in restricted or sanctioned jurisdictions (according to OFAC/UE/UK lists and FundUp's current policy); this list is dynamic and may be updated.

No persons listed in sanctions or using VPN/Proxy or loan sharks to evade geo-blocking.

Compliance with local laws: the participant declares that his/her participation does not constitute gambling and does not violate the laws of his/her country.

KYC: FundUp may request verification prior to participation and mandatory before awarding prizes; if there are coincidences of penalties or non-compliance, FundUp may block/cancel participation and/or revoke the prize.

One (1) count per person; violation entitles immediate disqualification.

  1. Nature of participation
    No registration fee is required for free tournaments.

In tournaments with paid registration, the costs, forms of payment and specific conditions will be informed in the corresponding call for entries.

In the case of paid tournaments, the refund policies published in the call for entries will apply.

Registration is personal and non-transferable.

  1. Registration and competition accounts
    Participants must create a profile on the FundUp tournament platform.

Each participant will receive access credentials to a competition account under predetermined conditions (e.g. initial balance, leverage, instruments enabled).

It is strictly prohibited to create multiple registrations, share credentials or use duplicate IP addresses/users.

FundUp may perform technical audits to verify compliance (IP, operation logs, devices used).

  1. Tournament rules
    The specific rules published in each call will apply (e.g. daily and total loss limits, minimum days traded, hedging restrictions, overnight or weekend operations, etc.).

The use of expert advisors (EAs), high frequency bots or any automated tool is prohibited unless expressly stated otherwise in the solicitation.

There may be a maximum limit of operations per day and per instrument, detailed in the specific rules.

FundUp may modify or update the rules prior to the start of the tournament and will communicate it on the official website.

Failure to comply with the rules may result in immediate disqualification and forfeiture of any right to a prize.

After the start, there will only be changes due to force majeure, critical platform/supplier failure, security incidents or generalized fraud; possible measures: pause, rescheduling or cancellation.

If the change alters substantial conditions (duration, P&L/draw rules, prizes), the Participant may accept the rescheduling or request a refund (proportional if the Tournament has already progressed).

The notification of changes is understood to have been made when published on the Tournament website and/or sent to the registered mail (presumption of receipt after 24 hours without bounce).

  1. Prizes
    Prizes will be published in each tournament announcement and will include details about their nature (e.g. funding accounts, cryptocurrencies or others).

Prize fulfillment will be subject to KYC verification and AML compliance.

The maximum period to claim the prize will be 30 days from the official notification. After this period, the right to the prize will be forfeited.

Prizes are personal and non-transferable.

  1. Ranking and transparency
    FundUp will publish a Leaderboard on its official website so that participants can follow the progress of the tournament.

In the event of a tie, additional criteria (number of transactions, consistency, lower drawdown) will be applied, which will be detailed in the call for proposals.

FundUp reserves the right to review and audit accounts before confirming winners.

  1. Penalties and disqualification
    The following shall be disqualified:

Use multiple accounts or shared IPs.

Employ prohibited techniques (arbitrage, price manipulation, bots, etc.).

Deliberately violate the tournament rules.

Disqualification means immediate forfeiture of the prize and exclusion from future tournaments.
It is forbidden to: (i) multi-account or share credentials; (ii) collusion/copy-trading (incl. mirroring); (iii) unauthorized bots/EAs or scripts; (iv) latency arbitrage, use of unauthorized feeds/data or exploitation of bugs; (v) spoofing/layering/quote stuffing; (vi) circumvention of geoblocks/sanctions (VPN, spoofing).
FundUp may audit IP, device-ID and logs, require enhanced testing/KYC, and void results, disqualify, withhold prizes and suspend/close accounts. The participant will have 72 hours to appeal from notification. Logs will be retained for as long as strictly necessary, in accordance with the Privacy Policy.

  1. Limitation of Liability
    FundUp does not guarantee uninterrupted availability of the competition platform and is not responsible for technical problems, server crashes, internet outages or other factors beyond its control.

The results of the competition may be audited and corrected if technical or behavioral anomalies are detected.

Participation in the tournament in no way implies a promise of future financial results or constitutes investment advice.

The Platform and Tournaments are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including, without limitation, merchantability, fitness for a particular purpose, accuracy of market data, uninterrupted availability or freedom from error.
To the fullest extent permitted by applicable law, FundUp, its affiliates, officers, employees, contractors, technology and data providers, and allies (collectively, "FundUp") shall not be liable to Participant for indirect, incidental, special, punitive, exemplary, consequential or lost profits, loss of opportunity, loss of data or damage to reputation, even if advised of the possibility of such damages.
FundUp's total liability to a Participant for all claims arising out of the same Tournament (whether in contract, tort or otherwise) shall not exceed the amount actually paid for the Participant's entry in the applicable Tournament. Multiple claims will not increase this cap. The cap also applies to affiliates, officers, employees and suppliers of FundUp.
FundUp is not liable for failures, delays, pricing errors, latency, crashes, scheduled or unscheduled maintenance, cyber-attacks, acts of God or force majeure, nor for third party services or infrastructure (cloud/hosting providers, payment gateways, blockchain networks, brokers or simulation data feeds, internet operators). The Participant acknowledges that these factors may affect the experience, P&L calculation, execution and results.
The Participant is responsible for backing up its data (e.g., configurations, reports, evidence). FundUp assumes no duty of custody or retrieval of information.
Any claim must be notified in writing within 30 days of the event giving rise to the claim (or at the time when it could reasonably have become known). After this period, the claim will be considered untimely.
The Tournaments are conducted in simulation accounts; there is no real negotiation or custody of the participant's money.

They are skill competitions with objective technical rules (e.g., P&L, drawdown, days traded); they do not constitute financial advice, instruments or securities offerings, or fundraising.

Participation does not guarantee results or prizes; these depend on performance and compliance with KYC rules and verification.

Any award (including a funding account) is not an investment or a promise of future returns; the participant assumes its tax obligations.

Market information and the Platform are provided "as is" for competition and training purposes.

  1. Intellectual property
    All FundUp content, trademarks, logos and materials are the property of FundUp OÜ and may not be used without prior permission.
  2. Data Protection
    FundUp will process participants' personal data in accordance with its current Privacy Policy.

The data will be used only for the management of the tournament and, where appropriate, for the delivery of prizes.

  1. Modifications and cancellations
    FundUp reserves the right to modify these Terms and Conditions at any time.

In case of cancellation of the tournament due to force majeure, FundUp will notify participants and, in the case of paid tournaments, may apply refund policies.

  1. Jurisdiction and Applicable Law
    These Terms and Conditions are governed by the laws of the Republic of Estonia. Any dispute shall be submitted to the competent courts of Tallinn, Estonia.
